The Garda Compensation Claims Scheme is set up by the Department of Justice with the intention to compensate members of the Gardaí or their families in the case of injury or death during the course of performing policing duties. It is essential that the application is submitted to the Department of Justice within three months of the date that you suffered injury and this is set out in the Garda (Compensation) Acts 1941-1945. It is very important that your injury is properly documented by your own doctor and where relevant consultants. It is important that you check in regularly with your own treating doctor and it is expected that you would also submit to a medical examination by the Garda Chief Medical Officer who will provide a medical report for the Department. The report from your own treating doctors and the Garda Medical Officer shall be comprehensive detailing your history, condition and prognosis (if known).
It is advisable to seek professional legal assistance when completing the application form for compensation. If a certificate of authorisation is received you can then proceed to lodge legal papers with the High Court and this should be lodged within two months from the date your application was authorised. You will then issue High Court legal proceedings naming the Minister for Finance as the defendant and the Chief State Solicitor’s Office will take over the handling of the defence of the legal proceedings.
The amount of compensation normally recovered will depend on the extent of your injuries and the time it takes for your recovery as well as any out of pocket expenses incurred by you, past and into the future. In addition potential future loss of earnings can be recovered in certain circumstances. It is important you obtain your own independent medical opinions to supplement the Garda Medical Officer. The Garda Compensation Scheme works on the basis that your legal costs will be recovered by the State and we would not propose charging any fees or deduction from your compensation payment.
